Who needs to comply with the E-com Act?

The new Norwegian Electronic Communications Act (EKOM), applies to any website or app that targets Norwegian users or operates in the Norwegian market, regardless of the domain name or language. This includes:
  • Websites under a .no domain
  • Websites or apps in Norwegian
  • Websites or apps targeting a Norwegian audience, such as those that:
    – Advertise to Norwegian users
    – Offer prices in Norwegian kroner (NOK)
    – Have features tailored for Norway
    – Collect personal data from Norwegian residents

What happens if I don’t comply with the updated E-com Act?

The penalties for failing to comply with the Norwegian Electronic Communications Act can be severe:
  • For breaches of the Electronic Communications Act, fines of up to 5% of a company’s total sales revenue from the previous accounting year can be imposed, depending on the length and severity of the infringement.
  • For repeated infringements related to the duty to respond to information requests, penalties can reach up to 4% of the company’s annual turnover or up to 25 million NOK, whichever is higher.
To collect valid cookie consent under the new Norwegian Electronic Communications Act, you should:
  • Obtain active, specific consent from users before placing non-essential cookies on their devices.
