On July 10th, 2021, the Italian Data Protection Authority Il Garante released a new set of guidelines for using cookies on websites.

The guidelines are published to ensure that Italian website owners and businesses comply with the GDPR and the ePrivacy Directive (the “European cookie law”).  

Italian companies now have six months to bring their cookie banners into compliance.

Here are the 6 key rules for using cookies in Italy:

  • Consent to cookies must be obtained through a cookie banner.
  • The user must be able to continue browsing without being tracked by cookies.
  • Scrolling or swiping a web page is not considered valid consent.
  • The user must be able to withdraw consent at any time.
  • The user must be provided information about the duration of cookies.
  • No cookie walls.
